These Terms of Service apply to your use of cdlaquatics.co.uk and to orders placed through the website.

Please read these terms together with our Shipping Policy, Refund and Returns Policy and Privacy Policy.

Nothing in these terms limits or affects your statutory consumer rights.

In these terms, “we”, “us” and “our” refer to Yorkshire Aquatic Supplies Limited, trading as CDL Aquatics. “You” and “your” refer to the person using the website or placing an order.

2. Application of these terms

These terms apply where you purchase goods wholly or mainly for personal use rather than for business purposes.

By placing an order, you confirm that:

  • you are legally capable of entering into a contract;
  • the information you provide is accurate and complete;
  • you are authorised to use the payment method supplied; and
  • you accept the terms applying to the order.

3. Website accounts

You may be able to create a customer account to view orders, save delivery details or use other website features.

You are responsible for:

  • keeping your login details confidential;
  • providing accurate account information;
  • updating your information when it changes; and
  • informing us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where reasonably necessary to protect you, other customers, our website or our business from fraud, misuse or unauthorised activity.

4. Product information

We take reasonable care to ensure that product descriptions, specifications, compatibility information, prices and images are accurate.

Product packaging, labels or minor cosmetic details may occasionally differ from the images shown where a manufacturer has updated a product or its packaging. The goods supplied will still correspond with the material product description and selected variant.

Colours may appear slightly different depending on photography, lighting and screen settings.

Measurements, capacities and technical specifications should be treated as approximate unless expressly stated otherwise.

Goods supplied to consumers must be of satisfactory quality, fit for their usual purpose and match their description.

5. Product compatibility

Some products are designed for particular aquarium filters, pumps, models or product generations.

Before ordering, please check:

  • the equipment manufacturer;
  • the exact model number;
  • the required size or capacity;
  • the product description;
  • the manufacturer’s part number, where shown; and
  • any compatibility information provided.

Similar-looking parts are not necessarily interchangeable.

Where you are unsure, please contact us before ordering and provide the equipment make, model and any relevant part number or photographs.

We take reasonable care when providing compatibility advice based on the information supplied to us. We cannot guarantee compatibility where the equipment details provided are incomplete or incorrect.

This does not affect your rights where a product supplied by us is faulty, incorrectly described or does not match advice based on accurate information you provided.

6. Aquarium treatments and care information

Aquarium treatments, water conditioners, test products, fish food and similar goods must be stored and used in accordance with the manufacturer’s instructions.

Before using a product, you should check:

  • that it is suitable for the intended aquarium;
  • that the aquarium volume has been calculated correctly;
  • the dosage instructions;
  • any warnings or exclusions;
  • whether sensitive fish, invertebrates or plants are present; and
  • whether other treatments are already being used.

Information provided on our website or in our aquarium guides is general fishkeeping information. It does not replace the instructions supplied with the product or appropriate veterinary or specialist advice.

7. Prices

All prices are shown in pounds sterling and include VAT where applicable.

The total price payable, including any applicable delivery charge or optional service, will be displayed before you place your order.

Standard UK delivery is free, subject to the geographical and product restrictions described in our Shipping Policy. Optional, expedited or specialist delivery services may involve an additional charge.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

We take reasonable care to display prices accurately. If we identify an obvious pricing or delivery-charge error before dispatch, we will contact you.

You may then either:

  • cancel the order and receive a full refund; or
  • confirm that you wish to proceed at the corrected price.

We will not take any additional payment without your agreement.

8. Payment

Available payment methods will be shown during checkout.

Payment may be authorised or taken when the order is placed. This does not necessarily mean that the order has been accepted.

You confirm that:

  • you are authorised to use the selected payment method;
  • the payment details supplied are accurate; and
  • sufficient funds or credit are available.

Payment providers may carry out security, identity or fraud-prevention checks under their own terms and privacy policies.

9. Placing an order

The checkout process allows you to review and correct your order before submitting it.

When you submit an order, you are offering to purchase the listed goods under these terms.

We will normally send an order acknowledgement by email. This confirms that we have received the order but does not necessarily mean that we have accepted it.

A contract is formed when we send a dispatch confirmation or dispatch the goods, whichever happens first.

The contract will relate only to the goods confirmed as dispatched.

10. Availability and cancellation by us

All orders are subject to availability.

We may decline or cancel an order before dispatch where:

  • the product is unavailable;
  • there is an obvious pricing or description error;
  • payment cannot be authorised;
  • fraud or unauthorised activity is suspected;
  • delivery cannot reasonably be made to the address supplied;
  • a purchase restriction has been breached; or
  • we are legally prevented from supplying the goods.

Where payment has already been taken for an order we cannot fulfil, we will refund the relevant amount using the original payment method.

We may offer a suitable alternative, but we will not substitute a materially different product without your agreement.

11. Delivery area

We currently deliver to addresses within the United Kingdom, excluding the Channel Islands.

Some products or delivery services may be subject to additional geographical restrictions. These will be explained on the product page, at checkout or in our Shipping Policy where applicable.

12. Processing and dispatch

Orders are processed Monday to Friday, excluding bank holidays.

Orders placed on a working day are generally dispatched the same day. Depending on the time the order is received, stock availability and carrier collections, please allow up to two working days for dispatch.

Orders placed during weekends or bank holidays will be processed from the next working day.

Same-day dispatch is not guaranteed unless expressly stated.

Delivery estimates begin once the order has been dispatched. They are estimates unless a guaranteed service is specifically stated.

13. Delivery and risk

You are responsible for providing a complete and accurate delivery address.

Where tracking is available, tracking details will normally be provided after dispatch.

Goods remain our responsibility until they are delivered into your physical possession or into the possession of a person you have identified to receive them.

Where you instruct the delivery company to leave a parcel in a nominated safe place or with a nominated neighbour, delivery to that place or person may be treated as completion of delivery.

Different rules may apply where you independently arrange a carrier that we did not offer.

Please contact us promptly if:

  • an item is missing;
  • the wrong item has been supplied;
  • the parcel or product is damaged; or
  • tracking shows delivery but the parcel cannot be located.

Unless another delivery period has been agreed, we will deliver the goods without undue delay and within 30 days of the contract being formed.

14. Large and palletised items

Some larger items may be delivered on a pallet to the kerbside or outside your property.

Pallet delivery does not normally include:

  • carrying the item inside your property;
  • moving it to another floor;
  • installation;
  • unpacking; or
  • removal of packaging.

You are responsible for ensuring that the delivery address has suitable access for the delivery vehicle.

Please contact us before ordering if you are unsure whether an item requires pallet delivery or whether access is suitable.

15. Cancelling an order before dispatch

Please contact us through our online Contact Us form as soon as possible if you wish to cancel or amend an order.

We will try to accommodate the request, but we cannot guarantee that an order can be changed or stopped once it has entered the dispatch process.

Where an order has already been dispatched, it may need to be returned under our Refund and Returns Policy.

16. Change-of-mind returns

For most online purchases, you have the right to tell us that you wish to cancel within 14 days after receiving the goods. You then have a further 14 days to return them.

CDL Aquatics also offers an extended 30-day change-of-mind returns period, subject to the conditions in our Refund and Returns Policy.

For change-of-mind returns:

  • contact us through our online Contact Us form before returning anything;
  • include your order number and details of the item;
  • follow the return instructions provided;
  • you will normally be responsible for return postage;
  • the goods should be complete and include all parts and accessories; and
  • a deduction may be made where handling beyond what was reasonably necessary has reduced the value of the goods.

Where an original delivery charge was paid, we will refund the cost of our standard delivery service. Any additional amount paid for an expedited or premium delivery service will not normally be refunded.

17. Exceptions to change-of-mind returns

The right to cancel may not apply to certain goods, including:

  • goods made to your specifications or clearly personalised;
  • goods that are liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return for health or hygiene reasons once unsealed; and
  • goods that have become inseparably mixed with other items after delivery.

Opened fish food, aquarium treatments and other consumable products cannot be returned under our extended 30-day goodwill policy unless they are faulty, damaged, incorrect or not as described.

Live animals cannot normally be returned as a change-of-mind return.

18. Faulty, damaged or incorrect goods

Please contact us through our online Contact Us form if an item:

  • arrives damaged;
  • develops a fault;
  • is not as described;
  • is not fit for its usual or agreed purpose; or
  • is different from the item ordered.

Please provide:

  • your order number;
  • a description of the problem;
  • relevant photographs or video, where useful; and
  • the product serial number, where applicable.

Please do not return the item until we have provided return instructions.

Depending on the circumstances and your statutory rights, the available remedy may include:

  • repair;
  • replacement;
  • price reduction; or
  • refund.

Your rights relating to faulty, damaged, incorrect or misdescribed goods are separate from our change-of-mind returns policy.

19. Electrical products and serial numbers

We may record the serial number of an electrical product before dispatch.

Any item returned must be the same product originally supplied.

A return may be refused or investigated where:

  • the serial number does not match;
  • a different product has been substituted;
  • parts or accessories are missing; or
  • there is evidence of deliberate misuse or unauthorised alteration.

This does not affect your statutory rights where the original product was faulty, damaged, incorrect or not as described.

20. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed with the offer.

Unless expressly stated otherwise:

  • promotions cannot be combined;
  • discount codes have no cash value;
  • a code must be entered before checkout is completed;
  • discounts cannot be applied retrospectively;
  • promotional stock is subject to availability; and
  • we may withdraw or correct an offer affected by an obvious error.

The withdrawal of a promotion will not affect an order that we have already accepted.

21. Customer reviews

Reviews must:

  • reflect a genuine experience with the product or CDL Aquatics;
  • be honest and not deliberately misleading;
  • disclose any incentive, free product or other benefit received;
  • avoid abusive, discriminatory, threatening or unlawful content;
  • avoid including another person’s confidential or personal information; and
  • not infringe copyright, trademark or other rights.

You must not submit or arrange:

  • a fake review;
  • a review presented as independent where an incentive has not been disclosed;
  • multiple reviews intended to manipulate a rating; or
  • false or misleading review information.

We may verify that a reviewer has purchased or used the product. We may refuse, label or remove content that breaches these terms.

We will not remove a genuine review merely because it is negative.

By submitting a review, you grant Yorkshire Aquatic Supplies Limited a non-exclusive, royalty-free licence to display, reproduce and format it in connection with CDL Aquatics and the relevant products. You retain ownership of your original content.

22. Acceptable use of the website

You must not:

  • use the website unlawfully or fraudulently;
  • attempt to gain unauthorised access to the website, customer accounts or connected systems;
  • introduce viruses, malware or other harmful code;
  • interfere with the website’s operation or security;
  • use automated systems to place fraudulent orders;
  • systematically extract or copy protected website content;
  • impersonate another person;
  • provide deliberately false information; or
  • use the website in a way that infringes another person’s rights.

We may restrict access where reasonably necessary to protect the website, our customers or our business.

23. Intellectual property

The website and its original content, including its design, text, CDL Aquatics branding, graphics and original photographs, are owned by or licensed to Yorkshire Aquatic Supplies Limited.

Manufacturer names, trademarks and product materials remain the property of their respective owners.

You may view and print website content for personal, non-commercial use.

You must not reproduce, republish, sell, commercially exploit or systematically extract website content without permission, except where permitted by law.

You may link fairly to publicly available pages on our website, provided that the link is not misleading and does not suggest an endorsement or association that does not exist.

24. Third-party websites and services

Our website may contain links to manufacturer websites, payment providers, delivery companies, social platforms or other third parties.

These links are provided for information or convenience. Unless expressly stated, they do not mean that CDL Aquatics endorses or controls the third-party website or service.

Third-party services operate under their own terms and privacy policies.

25. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory consumer rights; or
  • any other liability that cannot legally be excluded.

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, contracts, commercial opportunity or business interruption.

Nothing in this section affects the remedies available for faulty, misdescribed or unsuitable goods.

26. Events outside our reasonable control

We will not be responsible for a delay or failure caused by an event outside our reasonable control, including:

  • severe weather;
  • carrier disruption;
  • industrial action;
  • power or telecommunications failure;
  • cyberattack;
  • fire or flood;
  • government action;
  • import or supply-chain disruption; or
  • failure of a manufacturer or supplier.

We will take reasonable steps to reduce the effect of the event and will contact affected customers where appropriate.

This section does not remove any rights you may have where goods are not delivered within an agreed or legally required period.

27. Personal information

We use personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is explained in the Privacy Policy and through the website’s cookie banner and preference controls.

28. Changes to these terms

We may update these terms to reflect changes to:

  • the law;
  • our business;
  • the website;
  • payment or delivery arrangements;
  • Shopify functionality; or
  • our policies and services.

The terms applying to an order will normally be those presented when the order was placed.

The current version will be published on the website with the date of the latest revision.

29. General provisions

If a court or relevant authority finds that any part of these terms is invalid or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing a right does not mean that the right has been waived.

No person other than you and Yorkshire Aquatic Supplies Limited has any right to enforce a contract made under these terms.

30. Governing law and courts

These terms and any contract between you and CDL Aquatics are governed by the law of England and Wales.

If you live in Scotland or Northern Ireland, you retain any mandatory consumer protections that apply where you live and may be entitled to bring proceedings in your local courts.

We will try to resolve complaints directly before court proceedings become necessary.
